NOTICE OF CREDENTIAL USE CONDITIONS
Highlights

• Credentials are for work purposes. Use for nonworking purposes or use by spouses, friends, children, fans and other non-workers is not permitted. Violators will be ejected.
Credential Use Conditions
This working credential ("Credential") is issued as a revocable courtesy to an accredited agency (the "Agency") for the sole purpose of providing Canvas Stadium/Moby Arena access to an individual representative of the Agency (the "Representative") who has a legitimate working function in connection with the event (e.g., game, practice, press conference) for which this credential is issued (the "Event"). Acceptance of credentialed access to an Event constitutes agreement by the Agency and the Representative to be bound by (1) the following terms and conditions (the “Credential Use Conditions”) and (2) NCAA, conference and institutional rules regarding Event and student-athlete access.
This Credential is non-transferable and may be revoked at any time without cause. Any unauthorized use of this Credential or violation of its terms subjects the Representative to ejection from the Event venue(s), revocation of the Credential and prosecution for criminal and civil trespass and other legal action, and subjects the Agency to revocation of its access to future Events, as Colorado State University or its affiliates, agents or employees (collectively, the "Colorado State University") determines at its sole discretion.
This Credential (if issued for a media function) authorizes the use by the Agency, solely for news and editorial coverage of the Event, of any descriptions, accounts, photographs, films, audio or video recordings, or drawings of the Event or of any player interviews, press conferences or other stadium/arena activities related to the Event taken, made, created or compiled by the Agency or the Representative while attending the Event (collectively, "Agency Materials"). For the avoidance of doubt, Agency Materials may not be exploited by the Agency at any time for any purpose other than news and editorial use. Sale of images or video of student-athletes to third parties is expressly prohibited. Any other use or attempted use by the Representative or the Agency, including any distribution of Agency Materials to third parties for their use (whether before or after the conclusion of the Event, and whether or not for editorial purposes) and any authorization of any third party to redistribute Agency Materials is expressly prohibited, unless the Agency has obtained the advance written permission of Colorado State University for such other use.
As between the Agency, the Representative and Colorado State University, Colorado State University is the exclusive owner of all copyrights, trademarks and other proprietary rights in its names, logos and uniformed designs, and in the Event and all materials (in any and all media) related thereto, except for Agency Materials created pursuant to this credential (to the extent they do not incorporate materials owned by Colorado State University in accordance with the foregoing).
Representative and Agency shall not transmit or display any live-streamed or recorded video or audio of the Event in any medium, including websites and social media platforms, while the Event or the live network presentation of the Event is in progress, except with the advance written permission of Colorado State University.
While an Event is in progress, the Agency’s and Representative’s distribution of Event Material must be time-delayed and/or limited in amount (e.g., score updates with detail given only in quarterly game updates, fewer than 10 photographs during the game) and may not, under any circumstances, involve, constitute, serve as a substitute for, or otherwise approximate, a play-by-play or statistical account or depiction of the Event in any medium.
The Agency and Representative: assume all risk incident to the performance by the Representative of his or her services; assume all risk incident to attending Events; agree that Colorado State University, the NCAA, the Mountain West Conference and all associated persons (“CSU Entities”) have no responsibility for any equipment in use in the stadium; agree to waive any and all claims of bodily injury or damage to property that they might have against the CSU Entities arising out of the issuance of the credential or the Representative’s presence in the stadium; and agree to indemnify and hold harmless the CSU Entities from and against all liability, loss, damage or expense resulting from or arising out of the issuance of the credential card or the Representative’s presence in the stadium, except to the extent such liability, loss, damage or expense arises out of the willful or intentional misconduct of the CSU Entities. The Agency and the Representative also agree that they are not acting for the CSU Entities in any manner whatsoever and are not employees or agents of the CSU Entities. The Representative and his or her belongings may be searched upon entry into the stadium or other Colorado State University facility and/or other security checkpoints, and the Representative consents to such searches and waives any claims that he or she might have against the CSU Entities in connection therewith. If the Representative fails to consent to such searches, it is agreed and understood that he or she will be denied access to the stadium or other facility. Any Representative who is deemed disorderly, or who fails to comply with these Credential Use Conditions or any and all security measures, shall be subject to, if appropriate, ejection from the stadium or other facility and prosecution, and shall subject the Agency to revocation of its credentials for future Events.
Admission may be refused or withdrawn or the Representative ejected, or credentials revoked, in the sole discretion of the CSU Entities. If admission is refused or withdrawn, Representative is ejected, or a credential is revoked, or if the game is cancelled and not replayed, the Representative and/or Agency will not be entitled to consequential, incidental, indirect, exemplary, or special damages of any kind.
Terms and conditions in using the credential are in accordance with NCAA, Mountain West Conference and university policies. The bearer acknowledges receipt of all terms and conditions. Colorado State University reserves the right to change or modify these Credential Use Conditions at any time.
Unauthorized use, sale or transfer of a credential will result in ejection from the facility.
